guarantees our datacenter network/equipment reliability and performance.
This Service Level
Agreement (SLA) applies to customers of HOSTINGPRENEUR'™ web hosting, reseller, dedicated
server, and e-commerce.
ACCEPTABLE USE POLICY
By accessing HOSTINGPRENEUR.com and any pages thereof, you signify that you have read and agreed to be bound by the terms and conditions below. If you do not agree to the terms and conditions below, please do not access or use this web site or any pages thereof.
HOSTINGPRENEUR' general policy is to act as a provider of hosting services. HOSTINGPRENEUR reserves the right to suspend or terminate any of your access to any or all services provided by HOSTINGPRENEUR when we decide that account has been inappropriately used. In the event that there is a dispute between you ("Customer") and HOSTINGPRENEUR ("Company") regarding what is appropriate, HOSTINGPRENEUR' interpretation, in its most reasonable commercial judgment, shall take precedence.
In order to deliver the best in class service to you as HOSTINGPRENEUR' prime customer and offer a quality, credible and possibly the fastest environment, HOSTINGPRENEUR has developed this Acceptable Use Policy ("AUP") to govern the appropriate conduct allowed and not allowed within HOSTINGPRENEUR' network. HOSTINGPRENEUR reserves the right to immediate action to suspend or terminate your account when abuse is affecting other clients, and without notice when needed.
Below is the outline of details of the Acceptable Use Policies. Should you violate any of these provisions, HOSTINGPRENEUR reserves the right to terminate your account as determined HOSTINGPRENEUR in its sole discretion.
UNACCEPTABLE CONTENTS
HOSTINGPRENEUR provides hosting services that you may use only for lawful purposes. You agree to indemnify and hold harmless HOSTINGPRENEUR from any claims resulting from the use of services and servers that HOSTINGPRENEUR reasonably believes unlawful including, but not limited to copyrighted material, material we judge to be threatening or obscene, pornographic or material protected by trade secret and other statute. The following is the list of some unacceptable contents:
- Pornography that includes but not limited to child pornography and/or adult-related materials
- Software Piracy that includes but not limited to wares
- Technical Copyright Violation patent, trademark, or other intellectual property right
- Illegal Drugs & Gambling
- Defamatory Sites that may cause risk to a person's safety, health, privacy, security, hatred
- Deceptive Sites which includes but not limited to those governed by Consumer Protection laws
- Political Information
- Hacks that include materials, links or resources for hacking, phreaking or virus propagation that would compromise security and integrity of HOSTINGPRENEUR
- We do not tolerate abuse towards our staffs or against other clients of ThePreneurs Networks, verbal or published. Any account found to exercise such abuse in any form (e.g., slander) is ground for termination subject to our internal investigations.
- File hosting or mass storage of personal files (i.e., mp3, video files and the like) or any files not associated with the account are not allowed.
- Torrents in any form and/or proxies are prohibited
UNAUTHORIZED ACCESS TO OR USE OF DATA, SYSTEMS OR NETWORKS
You may not engage in any unauthorized use of accounts of other customers, data, systems or networks that belong or does not belong to HOSTINGPRENEUR and will probably interfere with other customers of HOSTINGPRENEUR. Any such illegal, abusive or irresponsible conduct with result to warnings, account suspension or termination, and civil or criminal legal action by HOSTINGPRENEUR depending on the severity
as determined in its own discretion. HOSTINGPRENEUR will strongly take actions in any attempt to use a customer account without proper authorization from the owner, written or expressed. Such attempt includes password recovery manipulations & others.
SYSTEM HOGS
The following are some of the classifications of systems hogging that causes and/or brings high load to CPU and memory and probably take server down at high load:
- Chat Rooms need approval from HOSTINGPRENEUR to get installed on any customer website. Alternatively, you are allowed to use remotely-hosted services.
- CGI Message Boards scripts tend to slow down any server and is not allowed. HOSTINGPRENEUR recommends to customer to use bulletin boards like VBulletin, SMF, phpBB, etc.
- IRC or IRC Bots are not presently allowed unless given permission by HOSTINGPRENEUR
- Background Running Programs that require more than 8MB of memory space, more than 30CPU seconds, or use more than 5% of all available system resources at any time are not allowed
HOSTINGPRENEUR reserved the right to terminate all given permissions if found to over-load the server.
BANDWIDTH/TRAFFIC POLICIES
You are given an allocated bandwidth per month as defined by your plan. We will attempt to contact you in every possible way to remind you of the excess bandwidth your website is consuming. We reserve the right suspend your account if we have not receive any response within a reasonable period of time.
As such, any amount exceeding such traffic would incur an extra charge of $1.0/GB. Unused bandwidth will not be carried over to the following month.
E-MAIL ACCEPTABLE USE
HOSTINGPRENEUR prohibits spamming and bulk mail sent to persons who have otherwise not requested to receive such mail.
If your are found to use your e-mail for spamming will have your account terminated immediately.
Authorized bulk mails to more than 50 users each time is under your discretion. Any bandwidth excess is subject to extra charge of $1.0/GB.
DOMAIN NAME REGISTRATION SERVICES
HOSTINGPRENEUR on occasion will register a domain name according to the offer posted in our site as part of the service rendered. This domain name is the property of HOSTINGPRENEUR until the first year of paid service is completed. Afterwards, you are given two options to either (1) renew and/or transfer the domain name with another domain registrar, or (2) have HOSTINGPRENEUR do these for you at a discounted price of $6.0 per domain name. HOSTINGPRENEUR will assess a $9.95 charge for accounts terminated before the first year is completed. This is to cover the expense of registering the domain name for you.
BILLING
You are responsible to update your particulars (e.g. address change, payment mode, billing info, etc.).
ThePRENEURS is not responsible for sending out monthly statements or invoices unless by request. Requested invoices will incur a small fee. Only when we have successfully billed you (i.e., paypal, credit card, etc), a confirmation e-mail will be sent out. Payments will be automatically charged on a monthly basis and is due in advance. Any unsuccessful billing, you will be notified of the denied charges. Any account that is past due after 2 days will be suspended and is subject to 5% late fees. Reactivation of suspended hosting accounts is subject US$10 processing fee. Any accounts that are past due after 5-days will be terminated. ThePreneurs Networks is not liable for any loss of files associated with the account.
Master Reseller and Reseller accounts that failed to meet payment requirements are subject for immediate termination after 5 days of non-payment and/or non-contact afterwhich respective clients of Master Resellers and Resellers are subject for ThePreneurs Networks takeover. We will send advisories to your respective clients allowing them to stay with ThePreneurs Networks under our hosting services with their billing to be transferred to ThePreneurs Networks.
PRICE CHANGE
Any customer is in no way under contract with HOSTINGPRENEUR. As such, any price change that HOSTINGPRENEUR reserves the right to implement at any time, you will receive a 30-day notice. You will not be affected with this change within the duration of your plan pre-paid term.
CANCELLATION OF SERVICE
If for any reason you are not satisfied with the services we are providing and opt to cancel your account with HOSTINGPRENEUR within 15 days of purchase, you may request a refund. The 15-day Money Back Guarantee applies only to hosting services, and does not apply to any other products or services including but not limited to domain names, SSL certificates, dedicated IP addresses, or other licenses. HOSTINGPRENEUR reserves the right to limit this refund in its sole discretion. There is no reimbursement and no-pro-rate if you decide to terminate the services before the end of a pre-paid term regardless of the reasons for the termination. Refunds may take up to two weeks to process. No, Refund on Promo/ Review Accounts.
RESELLERS
All master reseller/resellers has no tie with HOSTINGPRENEUR and in no relationship or whatsoever with HOSTINGPRENEUR other than to allow reseller to sell HOSTINGPRENEUR services. Resellers as well as their CLIENTS are all bound by this AUP. Resellers should not make policy or any kind of agreement for their clients that would contradict to HOSTINGPRENEUR policies. You are expected to provide first-hand support to your respective clients. However, ThePreneurs Networks staff would be glad to assist you through our ticket system.
BACKUPS
ThePreneurs Networks encourages clients to perform self-backup for their account and clients' accounts. Though we at ThePreneurs Networks are doing file backups to our own discretion, we are not responsible for any loss of clients' files
DISCLOSURE TO LAW ENFORCEMENT
ThePreneurs Networks specifically prohibits the use of our network/hosting services for unlawful purposes. Any information, inclusive of assigned IP numbers, account history, account use and anything that pertains to the account holder, will be turned over to the law enforcement agency after the latter's written request and without prior notice to the account holder.
LIMITATION OF LIABILITY
Under no circumstances shall HOSTINGPRENEUR, its contributors, or other third parties mentioned at this site be liable for any damages whatsoever (including without limitation, those resulting from expense or lost profit), direct or indirect, special or consequential damages arising out of the use, or the inability to use, or the results of use of the materials in this web site, any web sites linked to this site, or the materials or information contained at any or all such sites regardless whether HOSTINGPRENEUR has been advised of the possibility of such damage.
As the internet is unpredictable, customers are aware that networks availability is not guaranteed to be 100% available. If the problem occurs within the control of HOSTINGPRENEUR, we will issue credits that can be used towards any service at HOSTINGPRENEUR. Credits will be based on the length of the downtime according to your pre-paid plan. HOSTINGPRENEUR shall not be liable for any claims resulting from the corruption or deletion, of any website or data during these downtimes.
DISCLAIMER
The material contained in this web site has been compiled in "AS IS" without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. HOSTINGPRENEUR makes no representation that materials on this site are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.
